Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Cedar South Dev LLC dba Campday (“Campday,” “we,” “us,” or “our”) governing your use of our websites, admin console, parent portal, staff point-of-sale application, and related services (collectively, the “Services”).

By accessing the Services or creating an account, you agree to these Terms and our Privacy Policy.

1. Role of Campday

Campday provides software used by camps, retreat centers, and similar camps (“Camps”).

Campday is not a camp, childcare provider, or program operator. All services, activities, and decisions are provided and controlled by the Camp.

2. Eligibility and Accounts

You must be at least 18 years old to create an account.

Camper records are managed by parents, guardians, or Camps.

You are responsible for:

  • Account security
  • All activity under your account
  • Accuracy of information submitted

3. Services

Campday provides tools including:

  • Registration publications, audience targeting, enrollment groups and options, capacity blocks, waitlists, and coupons
  • Multi-step application processes, including digital forms, waivers, consents, signatures, and document uploads
  • Payments, registration deposits, installment and autopay plans, refunds, store credit, prepaid balances, and point-of-sale
  • Communication tools for transactional and Camp-directed messages via email, SMS, and web push
  • Reporting and operations

Services may be updated at any time.

4. Payments, Deposits, and Prepaid Balances

  • Payments are processed by third-party providers including Stripe
  • The Camp is the merchant of record
  • Campday does not hold or control funds
  • Registration deposits, installment plans, and autopay schedules are configured by the Camp; by enrolling on a plan or enabling autopay you authorize the saved payment method to be charged on the schedule shown at the time of enrollment
  • Coupons, discounts, refunds, store credit, and arbitrary adjustments are issued at the Camp’s discretion and governed by the Camp’s policies
  • Prepaid balances are held by the Camp, not Campday
  • Balances are not bank accounts and do not earn interest
  • Refunds and disputes are handled by the Camp

5. Health Information, PHI, and HIPAA

The Services may display health and allergen information provided by parents or Camps.

This information:

  • Is not verified by Campday
  • May be incomplete or inaccurate
  • Is provided for convenience only

Campday is not a healthcare provider and the Services are not intended for medical or clinical use.

Users must verify all health and allergen information directly with the Camp.

Where a Camp is a HIPAA Covered Entity or otherwise treats camper health records as Protected Health Information (PHI), Campday acts as a Business Associate and processes PHI under a Business Associate Agreement (BAA) with the Camp. Components of the Services that store or transmit PHI rely on subprocessors covered by Campday’s own BAAs, including a HIPAA BAA with Amazon Web Services covering S3 (document storage with SSE-KMS encryption and optional Object Lock), AWS KMS (key management), and Amazon SES (transactional email). PHI is not transmitted through subprocessors that are not BAA-covered, and Camps must not place PHI in SMS, push notifications, or other channels not covered by an applicable BAA.

6. Third-Party Food Data

Food and allergen data may be sourced from third-party databases including Open Food Facts.

Such data:

  • Is community-contributed
  • May be incomplete, outdated, or inaccurate
  • Must not be relied upon for medical or allergy decisions

Campday disclaims all liability from reliance on such data.

7. Communications, Email, SMS, and Push

By providing your contact information and using the Services, you consent to receive transactional communications necessary to operate your account and any registration, application, or payment you initiate. These include items such as account and login notices, registration receipts, application status updates, payment reminders and autopay notices, balance alerts, and other messages required to deliver the Services.

Camps may also send program-directed messages (announcements, reminders, surveys) by email, SMS, or web push where you have provided the consent appropriate to the channel. SMS messages are sent only after you have opted in to that channel; web push notifications are sent only after you enable them in your browser.

  • Message frequency may vary
  • Message and data rates may apply for SMS
  • SMS allocation: 50 SMS per registered camper per season are included in the platform fee. Additional SMS messages beyond this allocation are charged at $0.015 per message
  • SMS delivery is limited to one message per enrolled number per calendar day; messages in excess of this limit may be delayed or not delivered
  • You may opt out of marketing messages at any time by replying STOP to SMS, using the unsubscribe link in marketing email, or adjusting notification settings in your account; transactional messages required to operate the Services may continue

Camps are solely responsible for:

  • Obtaining required consent
  • Compliance with applicable laws (including TCPA, CAN-SPAM, and state-level analogues)
  • Message content and timing
  • Not placing Protected Health Information in SMS, push, or other channels not covered by an applicable Business Associate Agreement

Campday is not responsible for messages sent by Camps.

8. Acceptable Use and Prohibited Conduct

You agree not to:

  • Access other users’ data without authorization
  • Interfere with or disrupt the Services
  • Reverse engineer the platform
  • Submit false or misleading information
  • Use the Services for any purpose that violates applicable federal, state, local, or international law or regulation, including but not limited to laws governing data privacy, consumer protection, fraud, and child safety
  • Upload, transmit, or distribute content that infringes any patent, trademark, trade secret, copyright, or other intellectual property right of any person or entity
  • Use automated systems, scripts, or integrations that degrade system performance, create excessive load, or bypass intended use of the Services

Any illegal use of the Services is strictly prohibited. Campday reserves the right to suspend or permanently terminate any account involved in illegal activity, including copyright infringement, without prior notice. Campday may also report such activity to law enforcement or rights holders as required by law or as Campday deems appropriate.

Campday may throttle, restrict, or suspend usage that violates these rules.

9. Fair Use of Unlimited Features

Some Services are described as “unlimited,” including campers, parent records, items, and communications. Such usage must be consistent with normal camp operations.

Campday reserves the right, in good faith, to:

  • Impose reasonable limits
  • Restrict or suspend excessive or abnormal usage
  • Require alternative pricing where usage materially exceeds normal expectations

Campday will provide notice where reasonable.

10. Availability

Campday does not guarantee uninterrupted or error-free service.

The Services rely on third-party providers and infrastructure.

10a. Analytics and Session Replay

Campday uses Microsoft Clarity to understand how the Services are used and to improve them. Clarity records general usage information such as pages visited, clicks, scrolls, mouse movements, and limited browser and device metadata. Clarity may also capture session replays of interactions with the Services. Sensitive form fields (including medical, allergen, insurance, payment, and password fields) are masked and are not transmitted to Microsoft.

Microsoft acts as a data processor for this analytics data. See Microsoft's privacy statement at privacy.microsoft.com/privacystatement. You can opt out of Clarity by enabling “Do Not Track” in your browser or by blocking the clarity.ms domain.

11. Security Incidents

Campday uses safeguards designed to protect data.

In the event of a security incident, Campday will take commercially reasonable steps to investigate and provide notice where required by law.

12. Intellectual Property

Campday owns all rights to the Services.

You receive a limited, non-transferable license to use the Services.

13. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Campday is not liable for:

  • Camp operations or conduct
  • Injuries or incidents at Camps
  • Indirect or consequential damages

Total liability will not exceed the greater of:

  • Fees paid in the last 12 months, or
  • $100

15. Indemnification

You agree to indemnify Campday for claims arising from:

  • Your use of the Services
  • Your data
  • Violations of law

16. Governing Law

These Terms are governed by the laws of the State of New York.

17. Changes

We may update these Terms. Continued use constitutes acceptance.
